Course context for academic year 2017-18

This subject aim at helping students to acquire a complete and critical knowledge of the main concepts, principles and postulates of Legal Sociology. Students are expected to ask themselves about the legality of Law in society: Law, what is its’ purpose? Law, for whom? It therefore proposes a critical reflection on the role of Law in societies, especially the new millennium’s societies. To do this, we should call into question some statements that dogmatism has given for certain while reality, most of the times, for uncertain: the neutrality of legal operators, the omniscience of Law, the univocity of norms and many others. These approaches to legal issues appear to be those of the nineteenth century rather than those of the complex twenty-first century.

To achieve our purpose, students should become familiar with classical and contemporary theories about the relationship between Law and society, analyzing the influence of one another. In addition, they will be given the opportunity to know the results of specific empirical research on these issues. Teaching will be oriented to promote an analytical attitude in students, an attitude that allows them to judge on their own the theories and points of view related to Law and its’ social function.

Specific Competences (CE)

  • CE1 : Be able to describe fundamental concepts in the fields of psychology, sociology, law and natural sciences that are needed to provide a global analysis of criminal phenomena and deviation.
  • CE10 : Be able to explain and summarise empirical information and results of research into crime, victimisation and response to crime and deviation, and evaluate the methodology used (identify which methodology is the most appropriate, its ethical principles, results, etc.).
  • CE2 : Be able to describe the fundamental theoretical approaches to criminal acts, victimisation and responses to crime and deviation.
  • CE3 : Be able to extract and synthesise information from different sources, including: handling information and communication technologies, designing and applying appropriate research strategies for compiling data using quantitative and qualitative methods, and being able to apply basic statistical techniques to questions related to crime and victimisation when necessary.
  • CE5 : Be able to provide an analytical explanation of diversity and social inequality, as well as its consequences relating to criminal acts, victimisation and responses to crime and deviation.
  • CE8 : Be able to argue and describe different points of view and debate them in a logical and coherent manner and present conclusions in an appropriate academic format when dealing with questions of criminal policy, victimisation, criminalisation and responses to crime and deviation as well as on the perception and interpretation of the same by the communications media, public opinion and official reports.

OBJECTIVES:

• To identify the different theoretical conceptions of Sociology of Law among the classical authors
• To understand Law as a social fact.
• To analyze the influence of social factors on the production of contemporary law.
• To understand social processes in the formation of Law and in the application of the Law.
• To take up a stance when facing conflicts of interest that affect the Law.


COMPETENCES TO BE DEVELOPED:
• Working with variables when analyzing social reality of Law: organizing, searching, verifying, researching, systematizing, identifying and isolating those variables.
• Performance of written assignments: Monographs, essays, and slides in multimedia presentation.
• Developing the habit of reading sociological and legal texts.
• Teamwork and intragroup cooperation.
• Acquirement of an analytical attitude towards the social influences of the Law.
